Terms and Conditions
These terms and conditions (hereinafter referred to as: Conditions) apply to all purchases, contracts, deliveries, and other services agreed upon between the customer and OGER Holding BV (hereinafter referred to as: OGÉR).
General
1. These general terms and conditions (hereinafter referred to as: Terms and Conditions) apply to all purchases, contracts, deliveries and other services agreed between the customer and OGER Holding BV (hereinafter referred to as: OGÉR).
2. By making a purchase the customer agrees to be bound by these terms and conditions.
3. Unless OGÉR expressly agrees to this in writing, the customer's general terms and conditions do not apply.
4. OGÉR reserves the right to make changes to its website and/or these Terms at its sole discretion, without prior notice to the customer. OGÉR can do this based on its policy for updating and improving the website. Changes made by OGÉR do not affect orders already placed.
Concluding a contract
1. A contract is concluded when the order has been confirmed by OGÉR by e-mail to the e-mail address provided by the customer. Before this confirmation has been sent, OGÉR has the right to refuse an order or to subject it to special conditions, stating the reasons. If OGÉR is unable to clearly determine the customer's permanent or temporary address, a purchase cannot be accepted. OGÉR confirms the customer's purchase by email or purchase receipt.
2. Online purchases that are interrupted for any reason technically or otherwise before payment instructions are completed will be incomplete even when the customer has received confirmation. Such a purchase will therefore not be delivered. However, OGÉR will attempt to contact the customer to complete payment instructions so that an order can still be completed and delivery can take place.
3. OGÉR items are intended for individuals and may not be sold to professional parties.
4. Only persons aged 18 and over with a permanent home address can make a purchase at OGÉR.
Prices and costs
1. The contract price is the price published at the time of purchase from OGÉR. The prices of items are stated in euros and include VAT.
2. The prices stated at OGÉR do not include delivery costs.
3. OGÉR is not liable for (obvious) mistakes or (programming) errors with regard to the prices and/or descriptions it uses on its website. In these circumstances, OGÉR has the right to cancel the placed order or part thereof. In that case, OGÉR will only refund the amount paid by the customer (or part thereof) and is not liable for any damage suffered by the customer.
Execution of Purchases and Delivery
1. OGÉR will process the purchase of items with the greatest possible care.
2. Items will be delivered to the address the customer provided to OGÉR.
3. OGÉR will ship accepted orders as quickly as possible in the order they were received.
4. The delivery time stated on the OGÉR Online Store is only an estimate. OGÉR is in no way liable for loss, damage, costs, and/or expenses in the event of non-delivery according to the provided delivery or shipping dates, and there is no right to compensation if the actual delivery takes longer.
Customs, Duties & Taxes
1. The customer is responsible for ensuring that the item can be lawfully imported into the country of destination. In the case of international sales, the recipient is the registered importer and must comply with the laws and regulations of the country of destination. The customer is aware that the country of destination may be subject to import taxes, customs duties and levies for purchases shipped to countries outside the European Union. The recipient of an international shipment may be subject to such import taxes, customs duties and levies, which are charged once a shipment reaches the country of destination. Additional costs for customs clearance are borne by the recipient. OGÉR has no control over these costs and cannot predict how much they will be.
2. To prevent the customer from being confronted with unexpected costs, OGÉR advises the customer to contact the local customs office and inquire about the current costs before placing an order.
Right to return articles ('right of withdrawal')
1. The customer has the right to cancel the purchase agreement for an item bought online without giving reasons, within fourteen (14) days of delivery of the item, or in the case of an order for multiple items, on the day the customer received the last item if multiple items were ordered in the same order and delivered separately. This right also applies to discounted items. This right explicitly does not apply to custom-made and/or altered items. Returning an item results in the cancellation of the purchase of that item and the customer will receive a refund of the amount already paid to OGÉR for that item or items.
2. To exercise the right of withdrawal, the customer must inform OGÉR of the decision to withdraw from the agreement by means of an unambiguous statement (e.g., in writing by post or email). The customer may also use the attached model withdrawal form and/or our digital return form for this purpose, but is not obliged to do so. To comply with the withdrawal period, it is sufficient to send your communication concerning your exercise of the right of withdrawal to OGÉR before the withdrawal period of fourteen (14) days after delivery of the item has expired. The customer can also complete and send the model withdrawal form or another clearly formulated statement electronically to service@oger.nl. If the customer uses this option, OGÉR will immediately send the customer a confirmation of receipt of the withdrawal on a durable data carrier (e.g., by email).
3. The customer can also return or exchange an item in an OGÉR store. It is not possible to receive a cash refund for items returned to the store.
4. Items returned to OGÉR after the aforementioned 14-day period will not be refunded.
5. OGÉR has the right to charge the customer for any depreciation of a returned item in case of damage or if the customer has not followed the instructions for returning the item.
6. Products that are not suitable for return (perfumes and underwear) cannot be returned for reasons of health protection or hygiene. This also applies to items whose seal has been broken after delivery;
Shipping & Returns
During the sale period, we charge shipping costs of €5.95 for deliveries within the Benelux and €15.00 for deliveries outside the Benelux.
Returning ordered products is always the customer's responsibility. The cost depends on the carrier chosen. We recommend checking the rates of various carriers beforehand.
Incorrect delivery
If OGÉR delivers an item that does not correspond to the item ordered, or if the item is damaged or defective, the customer must inform OGÉR in writing as soon as possible within 48 hours by email to service@oger. NL. OGÉR will reimburse the purchase price plus any delivery costs.
Force majeure
1. OGÉR is not liable to the customer and does not breach the contract due to a delay in performance or failure to perform any of its obligations with regard to articles arising from a cause beyond OGÉR's reasonable control.
2. If OGÉR is unable to perform its obligations under the contract due to a cause beyond its reasonable control, OGÉR will notify the customer of this fact in writing as soon as possible after its discovery.
3. In the event of inability preventing OGÉR from fulfilling its obligations under the contract, with a minimum duration of two months, either the customer or OGÉR may terminate the contract in writing without mutual liability.
Complaints
1. If a customer wishes to exchange or return an item, they must follow the instructions provided on the Returns Policy page of this website.
2. Other questions, comments or complaints regarding a purchase, payment or delivery must be sent in writing to the following email address: service@oger.nl.
3. The e-mail message must state the name of the customer, the e-mail address that corresponds to the one in OGÉR's administration, the order number stated in the e-mail or receipt number on the purchase receipt and the item number.
Payment
1. The customer can pay with credit card, iDeal, Paypal and Klarna or cash (up to 10,000 euros) in the physical store. For cash payments above the stated amount, the customer must identify himself in the context of the Money Laundering and Terrorism Financing (Prevention) Act (Wwft). OGÉR gift vouchers cannot be exchanged for cash.
2. All payments must be in accordance with the instructions stated on the pages of the OGÉR Online Store.
Privacy
1. By making a purchase, the customer grants OGÉR the right to use their personal data where necessary. This data will only be stored for as long as is necessary to achieve the purposes for which the data is obtained and processed by OGÉR, i.e. the execution of the contract, for marketing purposes, and for maintaining contact with the customer.

Deviations
OGÉR cannot guarantee that the colours of the items are exactly the same as the colours shown on the customer's computer screen. This may be due to the display settings on the customer's computer.
